Terms of Use

These terms apply when you use the game "Spellfuse: Tower Defense" (the "App") and its website td.spellfuse.com (the "Site"). The App is operated by an individual developer ("we", "us"). By using the App you agree to these terms. If you do not agree, please do not use the App.

1. About these terms

  • These terms apply to everyone who uses the App, wherever they live.
  • If you are a minor, please get the consent of a parent or guardian before using the App, choosing a name or photo for the ranking, or making a purchase.
  • The terms of Google Play, where you got the App, also apply. If these terms and Google Play's terms conflict, Google Play's terms prevail.
  • These terms are between you and us, not Google. We, not Google, are responsible for the App, its support and its content.

2. Your licence

  • We give you a personal, non-commercial, non-transferable and revocable licence to use the App for your own play on devices you own or control. The App and its content are licensed to you, not sold.
  • The art, music, sound, text and code of the App belong to us or to their right holders (fonts and other materials we use under licence are listed in the App's credits).
  • You may freely use videos and screenshots made with the App for personal purposes, such as posting them on social media.

Please do not:

  • Copy, sell, rent or redistribute the App, or extract and publish its content
  • Reverse engineer or modify the App, except where the law where you live does not allow this to be restricted
  • Use cheating tools, bots, modified versions of the App or altered network traffic
  • Use the App in a way that breaks the law or the rights of others

3. Your account

  • The App makes a guest account for the world ranking when it first goes online. You can link it to your Google account to keep it on other devices. One account is for one person; please do not sell, share or transfer it.
  • Your game progress is saved on your device. The ranking account does not back up your save.
  • You can delete your ranking account at any time in the App (Ranking → Profile → "Delete account") or as described at td.spellfuse.com/data-deletion/.

4. Names and photos on the ranking

Your ranking name and profile picture are shown to every player. Please do not use a name or photo that:

  • Is sexual, violent, hateful, discriminatory, threatening or insulting
  • Harasses or targets another person
  • Impersonates another person, another player, Spellfuse or us
  • Shows or contains personal information or contact details (real full names of others, addresses, phone numbers, email addresses, URLs, social media accounts)
  • Shows another person without their permission
  • Infringes someone else's rights, such as copyright or trademark
  • Advertises something or is otherwise illegal or unsuitable for a game played by teenagers and adults

Names are checked automatically for banned words, and photos are checked automatically and, when needed, by a person before other players can see them. Every player can report a name or photo with "Report" and hide a player with "Block". We look at reports promptly, and we may hide or reset a name, remove a photo, hide records or suspend an account that breaks these rules, without notice.

5. Fair play on the ranking

  • Please do not submit records made with modifications, tools or altered network traffic, or disturb other players or the server.
  • We check every record. We may hide or delete records we judge to be impossible or cheated, and suspend the accounts that sent them, without notice.
  • If you believe a decision was wrong, contact us and a person will look at it.

6. Purchases and in-game items

  • The App is free to play. Optional in-app purchases (such as Sigils, Moonstone, Shards, starter offers, passes and the Moon Almanac) are sold through Google Play under Google Play's terms. Prices and contents are shown on the purchase screen.
  • The Moon Almanac lasts 30 days and does not renew on its own. There are no automatically renewing subscriptions in the App.
  • In-game items and currencies (Embers, Shards, Sigils, Moonstone, spells, wands, relics and the like) can be used only inside the App and have no monetary value. They cannot be exchanged for money or for anything outside the App, and cannot be sold or transferred.
  • Purchased items are saved on your device. Items that can be bought only once are given back on the same Google account by Google Play (for example after reinstalling). Consumable items such as Sigils, Moonstone and Shards are not restored if your save is lost.
  • Prices and product contents may change. This does not affect what you have already bought.

7. Random draws

  • In the Academy you can spend Sigils to draw spells, wands and relics at random. Sigils can be bought and can also be earned by playing.
  • The odds of each rarity and the pity count (the number of draws after which a high rarity is guaranteed) are shown in the App under "Odds & pity" before you draw. The odds shown are the odds used.

8. Minors and spending

  • If you are under 18 (or under the age of majority where you live), please make purchases only with the permission of a parent or guardian.
  • In the Japanese storefront of Google Play, the App asks your age before your first purchase and limits purchases to ¥5,000 a month if you are 15 or under, and ¥10,000 a month if you are 16 to 19.
  • Parents and guardians can also limit purchases with Google Play's parental controls and purchase approval.

9. Refunds

Refunds are handled by Google Play under its refund policy. We cannot issue refunds directly from the App. Nothing in these terms limits any refund or other right you have under the law where you live.

10. Restrictions

If you break these terms, or we reasonably judge that you are cheating or harming other players, we may limit or stop your use of the ranking and online features, or delete your ranking account, without notice. You can stop using the App at any time by deleting it.

11. Changes to the App and ending the service

  • We may change the game's content (such as balance, spells, foes and events) without notice.
  • We may change, suspend or end online features such as the ranking. Where possible we will give notice in the App in advance. The battles work without the online features.
  • We may stop distributing the App. In that case, refunds for past purchases follow Google Play's rules and the law.
  • The App may not work on every device or version of Android.

12. No warranty

  • The App is provided as is. We do not guarantee that it will always be available, be free of errors, suit a particular purpose or never lose save data. This does not affect any warranty or right that cannot be excluded under the law where you live.
  • Your save is stored on your device and can be lost through device failure, deleting the App and similar events.
  • If you have ever had a seizure triggered by flashing lights, or have concerns about your health, consult a doctor before playing. Take regular breaks. Settings can reduce flashing and screen shake.

13. Limitation of liability

  • Only where we are slightly negligent, our total liability to you in connection with the App and the Site is limited to the greater of the amount you paid us through the App in the 12 months before the damage occurred, or 1,000 Japanese yen. Also only where we are slightly negligent, we are not liable for indirect damage such as lost profits or lost data.
  • These limits do not apply where we act intentionally or with gross negligence.
  • Nothing in these terms limits liability for death or personal injury, fraud, or any other liability that cannot be limited under the law where you live (including your rights under Japan's Consumer Contract Act and consumer protection laws such as those of the EU, the UK and Australia).

14. Your responsibility

If you use the App in breach of these terms or the law and cause damage to us or to others, you are responsible for it to the extent the law allows.

15. Other services

When using the App, please also follow your other agreements, such as your mobile data plan. Other services opened from the App, such as Google and X, are governed by their own terms; we are not responsible for their content.

17. Changes to these terms

When we change these terms, we update their version and date and publish them on the Site. We announce material changes that are unfavourable to you in the App or on the Site before they take effect. Using the App after a change means you accept the new terms. Where the law requires your consent to a change, we will ask for it first.

18. Governing law and courts

  • These terms are governed by the laws of Japan. You keep any protection the law of the country where you live gives consumers that cannot be excluded by contract.
  • The Tokyo District Court has exclusive jurisdiction in the first instance over disputes about these terms or the App. This does not limit any right the law gives you, such as a consumer's right to bring a claim in the courts where they live.

19. General

  • If any part of these terms is invalid, the rest remains in effect.
  • If we do not enforce a right straight away, we have not waived it.
  • We are not liable when we cannot provide the App because of events beyond our reasonable control, such as natural disasters, network failures or outages at Google Play or our server providers (except for liability that cannot be limited by law).
  • These terms are written in English and Japanese. If the two differ in meaning, the Japanese version prevails, unless the law requires otherwise.

利用規約

この規約は、ゲーム「Spellfuse: Tower Defense」（以下「本アプリ」）とそのウェブサイト td.spellfuse.com（以下「本サイト」）を使うときに適用されます。本アプリは個人の開発者（以下「当方」）が運営しています。本アプリを使うことで、この規約に同意したものとみなします。同意しない場合は、本アプリを使わないでください。

1. この規約について

  • この規約は、住んでいる場所にかかわらず、本アプリを使うすべての方に適用されます。
  • 未成年の方は、本アプリを使う前・ランキングの名前や写真を決める前・購入の前に、保護者の同意を得てください。
  • 本アプリを入手した Google Play の規約も適用されます。この規約と Google Play の規約が食い違うときは、Google Play の規約が優先します。
  • この規約はあなたと当方の間のもので、Google との間のものではありません。本アプリとそのサポート・内容には、Google ではなく当方が責任を持ちます。

2. 利用の許諾

  • 当方は、あなたが所有または管理する端末で、あなた自身が遊ぶために本アプリを使う、個人的・非営利・譲渡できない・取り消せる権利を許諾します。本アプリとその内容は販売ではなく、利用の許諾です。
  • 本アプリの絵・音楽・効果音・文章・プログラムは、当方またはそれぞれの権利者のものです（許諾を受けて使っているフォントなどは本アプリのクレジットに記載しています）。
  • 本アプリで作った動画やスクリーンショットは、SNS への投稿など個人の目的で自由に使えます。

次のことはしないでください。

  • 本アプリの複製・販売・貸与・再配布、内容の抜き出しと公開
  • 本アプリのリバースエンジニアリングや改変（住んでいる国の法律で制限が認められない場合を除く）
  • 不正のツール・ボット・改変した本アプリ・改ざんした通信の使用
  • 法律やほかの人の権利に反する使い方

3. アカウント

  • 本アプリは、初めてオンラインになったときに、ワールドランキングのためのゲストのアカウントを作ります。Google アカウントに結びつけると、ほかの端末でも使えます。アカウントは 1 人に 1 つです。売ったり、共有したり、譲ったりしないでください。
  • ゲームの進み具合は端末に保存されます。ランキングのアカウントはセーブのバックアップではありません。
  • ランキングのアカウントは、本アプリの中（ランキング → プロフィール →「アカウントを削除」）や td.spellfuse.com/data-deletion/ の手順で、いつでも削除できます。

4. ランキングの名前と写真

ランキングの名前とプロフィールの画像は、すべてのプレイヤーに見えます。次のような名前や写真は使わないでください。

  • 性的・暴力的・憎悪をあおる・差別的・脅迫的・侮辱的なもの
  • ほかの人への嫌がらせや、ほかの人を狙ったもの
  • ほかの人・ほかのプレイヤー・Spellfuse・当方になりすますもの
  • 個人の情報や連絡先（ほかの人の本名、住所、電話番号、メールアドレス、URL、SNS のアカウント）を示すもの
  • 本人の許可なくほかの人が写ったもの
  • 著作権・商標などほかの人の権利を侵すもの
  • 宣伝、そのほか違法なもの、10 代と大人が遊ぶゲームにふさわしくないもの

名前は禁止の語を自動で確かめ、写真はほかのプレイヤーに見える前に自動で、必要なときは人が確かめます。どのプレイヤーも「通報」で名前や写真を知らせ、「ブロック」でそのプレイヤーを隠せます。当方は通報を速やかに確かめ、この決まりに反する名前を隠したり戻したり、写真を外したり、記録を隠したり、アカウントを止めたりすることがあります（予告なく行うことがあります）。

5. ランキングの公正

  • 改造・ツール・改ざんした通信で作った記録を送ったり、ほかのプレイヤーやサーバーの邪魔をしたりしないでください。
  • 当方はすべての記録を確かめます。あり得ない、または不正と判断した記録は、予告なく隠したり削除したりし、送ったアカウントを止めることがあります。
  • 判断が間違っていると思うときは連絡してください。人が確かめます。

6. 購入とゲームの中のアイテム

  • 本アプリは無料で遊べます。任意のアプリ内の購入（印・月石・魔石・スターターの品・パス・月の暦など）は、Google Play の規約のもとで Google Play を通じて販売します。値段と中身は購入の画面に表示します。
  • 月の暦は 30 日間有効で、自動では更新しません。本アプリに自動で更新する定期購入はありません。
  • ゲームの中のアイテムと通貨（残り火・魔石・印・月石・呪文・杖・レリックなど）は本アプリの中でだけ使え、金銭的な価値はありません。お金や本アプリの外のものと交換したり、売ったり、譲ったりはできません。
  • 購入したアイテムは端末に保存されます。1 回だけ買える品は、同じ Google アカウントなら Google Play が戻します（入れ直したあとなど）。印・月石・魔石のような消耗する品は、セーブがなくなると戻りません。
  • 値段や商品の中身は変わることがあります。すでに買ったものには影響しません。

7. ランダムに出る品

  • 魔導学院では、印を払って呪文・杖・レリックをランダムに引けます。印は購入でき、遊んで手に入れることもできます。
  • レア度ごとの確率と天井（高いレア度が必ず出るまでの回数）は、引く前に本アプリの「確率と天井」で表示します。表示した確率が実際に使う確率です。

8. 未成年と購入

  • 18 歳未満（住んでいる国の成人の年齢未満）の方は、保護者の許可を得てから購入してください。
  • Google Play の日本のストアでは、初めての購入の前に年齢を聞き、15 歳以下は月 5,000 円、16〜19 歳は月 10,000 円までに購入を制限します。
  • 保護者の方は、Google Play の保護者による使用制限や購入の承認でも購入を制限できます。

9. 返金

返金は、Google Play の返金のポリシーに従って Google Play が行います。本アプリから直接返金することはできません。この規約は、住んでいる国の法律で認められる返金などの権利を制限しません。

10. 利用の制限

この規約に反したとき、または不正やほかのプレイヤーへの迷惑があると当方が合理的に判断したときは、予告なくランキングやオンラインの機能の利用を制限・停止し、ランキングのアカウントを削除することがあります。あなたは本アプリを削除して、いつでも利用をやめられます。

11. 本アプリの変更とサービスの終了

  • ゲームの内容（バランス・呪文・敵・イベントなど）は予告なく変えることがあります。
  • ランキングなどのオンラインの機能は、変更・休止・終了することがあります。できる限り本アプリで前もって知らせます。戦闘はオンラインの機能がなくても遊べます。
  • 本アプリの配信をやめることがあります。その場合の過去の購入の返金は、Google Play の決まりと法律に従います。
  • 本アプリはすべての端末や Android の版で動くとは限りません。

12. 保証の否認

  • 本アプリは現状のまま提供します。常に使えること、誤りがないこと、特定の目的に合うこと、セーブデータが失われないことは保証しません。住んでいる国の法律で除外できない保証や権利には影響しません。
  • セーブは端末に保存され、端末の故障や本アプリの削除などで失われることがあります。
  • 光の点滅で発作を起こしたことがある方や、健康に不安のある方は、遊ぶ前に医師に相談してください。適度に休憩してください。設定の「光と動きを弱める」で光・点滅・揺れを弱められます。

13. 責任の制限

  • 当方の軽い過失による場合に限り、本アプリと本サイトに関して当方があなたに負う責任の合計は、損害が起きる前の 12 か月にあなたが本アプリで当方に支払った額と 1,000 円のうち大きい方を上限とします。また軽い過失による場合に限り、逸失利益やデータの消失などの間接の損害には責任を負いません。
  • 当方の故意または重大な過失による場合には、この制限は適用しません。
  • この規約は、死亡や身体の傷害、詐欺についての責任、そのほか住んでいる国の法律で制限できない責任（日本の消費者契約法や、EU・英国・オーストラリアなどの消費者保護の法律による権利を含みます）を制限しません。

14. あなたの責任

この規約や法律に反して本アプリを使い、当方やほかの人に損害を与えたときは、法律が認める範囲であなたが責任を負います。

15. ほかのサービス

本アプリを使うときは、携帯電話の通信の契約など、ほかの契約にも従ってください。本アプリから開く Google や X などのほかのサービスには、それぞれの規約が適用されます。その内容に当方は責任を負いません。

17. この規約の変更

この規約を変えたときは、版と日付を更新して本サイトに載せます。あなたに不利な重要な変更は、効力が生じる前に本アプリか本サイトで知らせます。変更のあとに本アプリを使うと、新しい規約に同意したものとみなします。法律で変更への同意が必要な場合は、先に同意をお願いします。

18. 準拠法と裁判所

  • この規約は日本の法律に従います。ただし、住んでいる国の法律が消費者に与える、契約で除外できない保護は失われません。
  • この規約や本アプリについての紛争は、東京地方裁判所を第一審の専属的な合意管轄裁判所とします。ただし、消費者が住んでいる場所の裁判所に訴えを起こす権利など、法律があなたに与える権利は制限しません。

19. 一般

  • この規約の一部が無効でも、ほかの部分は有効です。
  • 当方がすぐに権利を行使しなくても、その権利を放棄したことにはなりません。
  • 天災、通信の障害、Google Play やサーバーの委託先の障害など、当方が合理的に管理できない出来事で本アプリを提供できないときは、責任を負いません（法律で制限できない責任を除きます）。
  • この規約は英語と日本語で書いています。意味が食い違うときは、法律が別に定める場合を除き、日本語の版が優先します。
